Privacy Policy
At Artist Escrow Services (AES), protecting your privacy and the confidentiality of your personal information is important. AES is subject to the National Privacy Principles (“NPPs”) under the Privacy Act 1988 (Cth). The following Privacy Policy explains how AES manages and protects the privacy of your personal information under the NPPs.
Personal information
Personal information is any information or an opinion, whether true or not, which identifies you. When personal information concerns certain matters it is considered sensitive information.
Sensitive information may be information or opinion about your:
- racial or ethnic origin;
- political opinions;
- membership of a political association;
- religious beliefs, affiliations or philosophical beliefs;
- membership of a professional or trade association or membership of a trade union;
- sexual preferences or practices;
- criminal record;
Collection of personal information
Generally, AES will collect personal information directly from you. AES usually collects information such as your name, address, contact number and email address. Sometimes AES also collects sensitive information about you, such as information about membership of an association or health information. AES only collects sensitive information with your consent.
On occasions AES will collect personal information about you from someone else. For example, AES may collect personal information from:
- another party to ensure that no conflict of interest arises;
- a company for whom you work;
- other organisations with whom you have any dealings.
If AES collects personal information about you from someone else, AES will take reasonable steps to ensure you are aware of why the information is collected, how it will be used and to whom it will be disclosed.
Use of personal information
AES collects your personal information for the following purposes:
- to serve you as a client
- to advise you on all matters associated with you providing your entertainment or sporting services.
If you don’t provide personal information
If you do not provide the personal information AES’ requests, AES will not be able to provide you with effective advices associated with you providing your entertainment or sporting services.
Disclose of personal information
AES has a duty to maintain the confidentiality of its clients affairs including personal information. This duty of confidentiality applies except where disclosure of your personal information is:
- With your consent
- Your consent may be given either expressly or implied from your conduct. Where the provision of advices associated with you providing your entertainment or sporting services to you requires disclosing your personal information to a third party your consent would be implied when you engage AES unless you tell AES otherwise.
- Compelled by Law
- For example: in response to a subpoena.
If AES engages a third party contractor to perform services which involves handling personal information, AES takes reasonable steps to prohibit the contractor from using personal information except for the purposes for which it was supplied.
Direct marketing and your privacy
From time to time AES may use the personal information it collects about you to identify particular services and/or information which it believes may be of interest and benefit to you. AES may then contact you to let you know about these services and information and how they may benefit you. Please contact us if you do not want to receive any of this information.
Accuracy of personal information
If AES has accurate personal information about you, it enables AES to provide you with the best possible service. AES takes reasonable steps to ensure that the personal information AES collect, uses and discloses is accurate, complete and up to date. Please contact AES immediately if you find that the personal information AES holds about you is inaccurate, incomplete or out of date. AES will take reasonable steps to ensure your personal information is corrected.
Security of personal information
AES protects your personal information from loss, misuse, modification and disclosure. AES uses industry standard safeguards to ensure the security of your personal information through physical, electronic and managerial procedures.
For example:
- security monitoring of premises;
- code only access and alarm systems to prevent outside access to your personal information;
- internal policies in relation to secure computer use.
Employees of AES access your personal information only in order for them to carry out their employment. Our employees are committed to maintaining confidentiality.
When AES no longer requires your personal information AES securely destroys the information and deletes it from its systems.
Access to personal information
You may request access to any of the personal information AES holds about you. AES will, on request, provide you with access to the personal information AES holds about you, unless there is an exemption which applies under the Privacy Act. For example, AES may refuse you access to personal information where AES has a legal duty of confidentiality or non disclosure.
Your request for access will be dealt with in a reasonable time, AES may charge you a fee to cover the reasonable cost of retrieval and the supply of the information to you.
If AES refuses your request for access, it will provide you with reasons for the refusal.
Transferring your personal information overseas
AES does not transfer your personal information overseas unless AES is authorised by law to do so or you have consented to it as part of the accounting and taxation services AES provides to you.
